These Terms & Conditions (“Terms”) govern your use of the website lynxify.agency and the services provided by Lynxify, a Pakistan‑based creative agency. By accessing the website or engaging our services, you agree to be bound by these Terms. Please read them carefully.
1. Introduction & Acceptance of Terms
1.1 By visiting lynxify.agency or using our services, you acknowledge that you have read, understood, and agreed to these Terms.
1.2 These Terms apply to all clients, visitors, and users who interact with Lynxify’s services, including pitch deck design, branding and visual identity, UI/UX design, web design and development, book and editorial design, video editing, motion graphics, VFX, AI video production, and related creative services.
1.3 If you do not agree to these Terms, please refrain from using the website or engaging our services.
1.4 Your engagement with Lynxify constitutes a binding agreement governed by these Terms and any separate project, subscription, retainer, or engagement-specific agreement.
1.5 Users must be at least 18 years of age and legally capable of entering into contracts to use Lynxify’s services.
2. Scope of Services
2.1 Lynxify provides creative, design, development, and production services, including but not limited to:
Pitch deck and presentation design
Branding and visual identity
UI/UX design
Web design and development
Book and editorial design
Video editing, motion graphics, and VFX
AI video production
Related creative and strategic services
2.2 Each project, subscription, retainer, or custom engagement may have separate terms, deliverables, timelines, fees, and payment schedules agreed in writing. These engagement-specific terms take precedence over these general Terms where they differ.
2.3 Engagement Models
Lynxify provides project-based services, fixed-term creative subscriptions, retainers, and custom engagements. The applicable scope, fees, subscription term, active-request capacity, deliverables, timelines, and payment terms will be confirmed in the relevant proposal, invoice, checkout page, contract, or written agreement.
2.4 Creative Subscriptions
Creative subscriptions provide access to eligible Lynxify services during the paid subscription term. The number of requests worked on at one time depends on the selected plan, while additional requests may remain in the request queue.
Work is provided only during the paid term. Active or queued requests that are not completed before the term ends will stop unless the client renews or agrees to a separate engagement.
2.5 Scope and Additional Work
Only the services and work defined in the selected plan, contract, or written agreement are included. Large, urgent, technically complex, specialist, or out-of-scope requests may require an adjusted timeline, separate fee, and written approval before work begins.
3. Eligibility & Acceptable Use
3.1 To engage Lynxify’s services, you must be at least 18 years old and have full legal authority to enter into contracts.
3.2 Services must be used for lawful purposes only. You may not use our services or deliverables to:
Create or transmit illegal content
Conduct hacking, malware distribution, or cyber attacks
Publish harmful, offensive, or discriminatory material
Infringe the rights of any third party
3.3 Lynxify reserves the right to refuse service, suspend access, or terminate engagements if activities are illegal, abusive, harmful, or in violation of these Terms.
4. Payment Terms
4.1 Payment Terms
Project fees, subscription fees, retainers, milestones, and payment terms are agreed before work begins. Lynxify starts work only after the applicable advance payment, deposit, or subscription fee has been received.
For project-based work, 50% of the project fee is paid upfront before work begins. The remaining 50% is due after the client approves the draft. Final files and deliverables are handed over once the full project fee has been paid.
Payments may be made through Stripe, PayPal, Remitly, international bank transfer, Wise, Payoneer, cryptocurrency, or another approved method. Lynxify does not store client payment details directly.
4.2 Refunds and Cancellations
Refunds and cancellations for all services are covered in our Refund & Return Policy, which forms part of these Terms.
4.3 Payment Security
All payments are handled securely through our payment providers. Lynxify does not store or manage credit card or banking information.
4.4 Subscription Billing and Renewal
Subscription fees are paid in advance for the selected subscription term. Subscription services begin after payment is received and remain available until the end of the paid term.
Subscriptions do not renew automatically. Clients must renew manually if they wish to continue receiving services after the paid term ends.
Clients may choose not to renew and will continue receiving the agreed services until the end of their current paid term.
When the paid term ends, Lynxify will stop work on active and queued requests unless the client renews or agrees to a separate engagement.
5. Intellectual Property Rights
5.1 Lynxify Materials
Lynxify retains ownership of its pre-existing methodologies, templates, internal processes, reusable assets, tools, and production systems.
5.2 Client Rights
Upon full payment, clients receive the ownership or usage rights stated in the applicable project scope, contract, proposal, or written agreement. Third-party fonts, stock assets, plugins, software, and licensed materials remain subject to their respective licence terms.
5.3 Portfolio & Marketing Use
With express client permission, Lynxify may showcase project results, designs, or presentations in portfolios, case studies, or marketing materials. No confidential or sensitive client information will be shared without explicit consent.
5.4 Limitations
Clients may not redistribute, resell, or modify Lynxify’s proprietary assets outside of the agreed usage rights unless a separate license is granted in writing.
6. Revisions & Deliverables
6.1 Lynxify provides revisions according to the applicable project scope, subscription plan, contract, proposal, or written agreement.
6.2 Additional revisions outside the agreed scope may incur additional fees, which will be communicated clearly before work begins.
6.3 Clients may request editable source files (e.g., PSD, AI, PPTX, video project files) where applicable, subject to project agreement and potential additional fees.
7. Limitation of Liability & Disclaimers
7.1 All services and deliverables are provided “as‑is.” While Lynxify strives for the highest standards of quality and accuracy, no guarantee is made regarding specific business outcomes, approvals, funding success, or other external results.
7.2 Lynxify is not liable for:
Indirect, incidental, or consequential damages
Lost profits, revenue, or data
Errors in client‑provided content or instructions
7.3 Creative outcomes may depend on multiple factors beyond Lynxify’s control, including client use, market conditions, audience behavior, and external circumstances.
7.4 Lynxify is not responsible for third‑party links, tools, or external resources linked on the site that are outside of our control.
8. Indemnity
8.1 Clients agree to indemnify, defend, and hold Lynxify harmless from any claims, losses, liabilities, costs, or damages arising from:
Illegal or improper use of deliverables
Misrepresentation of content or information provided to Lynxify
Violations of applicable laws or third‑party rights
9. Governing Law & Dispute Resolution
9.1 These Terms are governed by the laws of Pakistan.
9.2 Any disputes arising under or in connection with these Terms shall be resolved in the courts of Pakistan, unless the parties mutually agree to binding arbitration in writing.
9.3 Clients agree that all claims will be brought in accordance with Pakistani law and proper venue.
10. Changes to Terms
10.1 Lynxify reserves the right to update or modify these Terms at any time.
10.2 Updated Terms will take effect when posted on the website. Continued use of services after changes indicates acceptance of the revised Terms.
11. Termination
11.1 Lynxify may suspend or terminate any service engagement or access to the website at any time for violations of these Terms, without prior notice.
11.2 Termination does not affect obligations or liabilities incurred before termination.
